Terms of Use

1. Acceptance

These Terms of Use govern your access to the Atama Drawing Tools Android app, this website, and any related services (together, the “Service”). If you use the Service on behalf of an organisation, you confirm that you have authority to accept these terms for it.

2. Eligibility and accounts

You must be at least 13 years old to use the Service, or older if your local law requires a higher age for digital consent. Community features and Studio require a Google account. You are responsible for activity on your account and for keeping access to your Google account secure.

You agree to provide accurate profile information and not to impersonate another person or misrepresent your affiliation with anyone.

3. Licence to use Atama

Subject to these terms, we grant you a personal, limited, non-exclusive, non-transferable, and revocable licence to install and use the app on devices you own or control, for your own drawing practice and lawful personal use.

You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the app, except where the law expressly permits it.

4. Your content

You keep ownership of the artwork, images, messages, and other content you create or upload. By sharing content in community features, you grant Atama a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and moderate that content solely to operate and improve the Service. This licence ends when you delete the content or your account, except for copies in backups or content others have already saved.

You are responsible for having the rights needed to upload your content. Reference images, 3D models, and other assets you import must be yours to use.

5. Community rules

Studio is a place for constructive drawing feedback. When using community features, you agree not to:

• Harass, threaten, bully, or discriminate against anyone.
• Post hateful, violent, sexually explicit, or unlawful content.
• Share content that exploits or endangers minors.
• Infringe copyright, trademarks, privacy, or other rights.
• Share another person’s private information without permission.
• Spam, advertise, or use the community for unrelated promotion.
• Impersonate others or misrepresent your identity.
• Upload malware or attempt to disrupt the Service.

6. Moderation and enforcement

We may review, remove, or restrict content that violates these terms or our community rules. We may also warn, suspend, or permanently ban accounts, and we may report unlawful content to the relevant authorities. Moderation decisions are made at our discretion, but you can appeal by emailing support@atamadrawingtools.com.

7. Studio membership and billing

Studio is an optional membership that unlocks community features. It includes a 1-week free trial, after which it costs $1.19 per month unless you cancel before the trial ends.

• Prices, taxes, and billing periods are shown at the point of purchase.
• If you purchase through Google Play, Google processes billing and refunds under its policies.
• You can cancel from Studio in the app or from your Google Play subscriptions.
• Cancellation stops future charges; access normally continues until the end of the paid period.
• We may change the price with reasonable notice. Changes apply from your next billing period.

If you believe you were charged in error, contact us and, where applicable, Google Play support. Nothing in these terms limits refund rights you have under applicable law.

8. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these terms. You may not interfere with the Service, bypass security or access controls, scrape data at scale, or use automated systems to access community features without our permission.

9. Intellectual property

The app, website, brand, design system, code, and original content are owned by Atama Drawing Tools or its licensors and are protected by intellectual-property laws. These terms do not grant you any rights to our trademarks or branding.

10. Third-party services

The Service relies on third-party services, including Google Firebase and Google Play. Your use of those services may be subject to their own terms. We are not responsible for third-party services we do not control.

11. Disclaimers

The Service is provided “as is” and “as available”. To the extent permitted by law, we make no warranties that it will be uninterrupted, error-free, or suitable for a particular purpose. Drawing tools are study aids, not professional advice.

12. Limitation of liability

To the extent permitted by law, Atama Drawing Tools is not liable for indirect, incidental, special, or consequential damages, loss of data, or loss of profits arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 10.

Nothing in these terms excludes liability that cannot lawfully be excluded, including your mandatory consumer rights.

13. Termination

You can stop using the Service at any time and delete your account in the app. We may suspend or terminate access if you breach these terms, if required by law, or if we discontinue the Service. Where reasonably possible, we will give notice before discontinuing the Service.

14. Changes

We may update these terms as the Service changes. We will post the revised terms here and update the date above. If a change is material, we will provide additional notice in the app or by email. Continuing to use the Service after a change means you accept the revised terms.
